Week 6 – Professional Practise

 My own experience of professional practice is very little as I have only been in the field of work for 3 years.

Currently I am the only conveyancer for the small firm in Kingaroy which is Woods Murdoch Solicitors.

In this line of work I deal with large amounts of money which go into the millions along with writing out cheque that are in the high thousands.

I handle contracts which are a simple 35 days settlement to contracts that going over 12 months. Water allocation, prioirty notices, extensions, early possession are all topics I have to handle on a day to day basis.

Professional practise is essential in this line of work. I have a procedure and specific requirements that I must comply with otherwise the sale or purchase of a property wont go through and could case the firm I work with serious consequences.

Week 6 – Professional Practise

My first year out of school I landed a job in the Local Government as a Finance Officer for the Local Council. I had the resposibility for authorising For many years I was involved in the Oil and Gas Industry , not only as a commissioning engineer but also as  Contracts Manager, with  the responsibility  for drawing up tenders for major construction contracts, many  having multi million dollar values.

This area of work included not only preparing and issuing the tenders, evaluating and awarding the work but also the administration, on site of the actual contracts – ensuring contractors complied with the conditions of the contracts, ensuring the client or owner understood and fulfilled its obligations and generally ensuring all parties worked within the legal framework  which the contracts where bound by.

As part of this , project procedures were an integral and critical part of  ensuring all stakeholders understood their roles, responsibilities and interaction with others.

Professional practice was essential,  the procedures had  to define who did what, they had to comply with the relevant laws and statutes as applicable to  Project work (Workplace Health and Safety; native title, environmental issues, the protection of subcontractors ; keeping local communities on side and the like) All this required me to ensure I was  up to speed with current issues and legislation. Now retired, I don’t miss it one bit

This area of work involves preparing all documentation and finances for the sale or purchase of a property. I have to ensure all funds are available and if there is a shortfall account to access. Making sure the release of morgtage has been completed for the sale of a property, and that the transfers have been completed.

JA Carroll & Son Solicitors has been a firm for over 88 within the South Burnett. They deliverer quality legal advice and help protect you in many areas of law including:-

JA Carroll & Son Solicitors also handles criminal law and is an agent for Legal Aid. Mark Werner one of the 3 Solicitors for the firm practices in the area of Criminal Law and Protection Orders (also known as Domestic Violence Orders). Mark has had many years experience in Criminal Law having had matters before in the Magistrates, District and Supreme Courts.

KF SOLICITORS

KF Solicitors offers premium legal services through the highly qualified team based within the South Burnett. Based in Kingaroy and Brisbane, KF Solicitors is a dynamic and progressive firm fully understand there clients’ legal position. KF Solicitors specialises in the following area’s of law:-

  • Family and Defacto Law
  • Conveyancing and Leasing
  • Wills and Enduring Powers of Attorney
  • Succession Planning and Estate Administration
  • Commercial Law
  • Criminal and Traffic Law
  • Personal Injury Law

Woods Murdoch Solicitors

Woods Murdoch Solicitors are the smallest law firm in Kingaroy with only one
Lawyer and 4 staff members. There qualified and experienced legal professionals
based in the South Burnett and offering legal services at cost effective rates.
Woods Murdoch are also an agent for Legal Aid in Criminal matters and the only
firm for family Matters. They also specialise in the follwing area’s law:-

  • Family and Defacto Law
  • Conveyancing and Leasing
  • Wills and Enduring Powers of Attorney
  • Succession Planning and Estate Administration
  • Criminal and Traffic Law

Between the above three firms it is clear that if a client needed help with
a family matter but had to go through Legal Aid then it they could only see Woods Murdoch Solicitors. However if they needed assitance in a ciminal matter then they could choose between JA Carrol & Sons or Woods Murdoch. KF Solicitors on the other hand is branched both in Kingaroy and Brisbane so would have a vast knowledge in all area’s of law and would be able to assist all there clients in the rightful manner.

The only advise I can give for JA Carroll and Sons is their website does not advertise Legal Aid very well and i belive it would turn potential clients off from using there services.

Week 4 – Learning Styles

Learning Styles

Firstly, lets start by understanding what the term “learning styles” means. Everyone understands and learns everthing differently. A person’s learning style refers to to the preferential way in which they absorbs, processes, comprehends and retains information.

For myself I learn through both visual and tactile styles.

Visual Learning

A visual learner understands and remembers things by sight. They can picture what they have learnt in there head, and the best learning methods are primarily visual.

Activities that better my visual learning style are:-

  • Maintain good eyesight
  • Visualizing things that I have heard or read.
  • When studying using flashcards
  • Write down instructions or ideas, and
  • Avoid other visual distractions when working or studying.

Tactile Style

A tactile learner on the other hand is learning through touch and doing. Learning is done by being ‘hands-on” which involves touching, moving, builing or drawing.

As a tactile learner, you like to take things apart and put things together, and you tend to find reasons to tinker or move around when you become bored. You may be very well coordinated and have good athletic ability. You can easily remember things that were done but may have difficulty remembering what you saw or heard in the process. You often communicate by touching, and you appreciate physically expressed forms of encouragement, such as a pat on the back.

Here are some things that tactile learners like you can do to learn better:

  • Participate in activities that involve touching, building, moving, or drawing.
  • Do lots of hands-on activities like completing art projects, taking walks, or acting out stories.
  • It’s OK to chew gum, walk around, or rock in a chair while reading or studying.
  • Use flashcards and arrange them in groups to show relationships between ideas.
  • Trace words with your finger to learn spelling (finger spelling).
  • Take frequent breaks during reading or studying periods (frequent, but not long).
  • It’s OK to tap a pencil, shake your foot, or hold on to something while learning.
  • Use a computer to reinforce learning through the sense of touch.

Week 3 – CPD

CPD stands for Contiuing Professional Development. Two professions that require CPD are Lawyers and Engineers.

LAWYERS

Practitioners are required under the Legal Professions Act 2007 s231 and Queensland Law Society Administration Rule 2005 pt 6 complete a minimum of 10 CPD points each year to maintain there practising certificate, stay up to date with legislation changes and the evolution of the business of law in their practise.

With reference to the Queensland Law Society website, practitioners can gain CPD points by attending

  • Seminers and Conferences
  • Reading articles in law journals and other legal publications, and
  • Become a member of the QLS.

ENGINEERS

Engineers that are qualified within Australia are required to the CPD national policies General Regulations 2016 div 3.

For engineers to mee the CPD requirements they must record 150 hours of completed CPD over a period of 3 years. If howevr they are working part-time or have had extended leave then the period is spread over 5 years.

The 150 hours is spread out across:-

  • 50 hours relating to the area of practise,
  • 10 hours of risk management,
  • 15 hours of addressing business and management skills, and lastly
  • Remaining hours are covered by the relevant interest and caree of the practitioner.

Week 2 – New Position

Starting in a small firm allows you to find your feet in the field and not become overwhelmemed with large projects. Your responsibilities would include but not limited to :-

  • Lodging relevant documentation with the Titles office.
  • Complete searches for the Certificate of Titles and any local government searches that may affect the property for example encumbrances or caveats, rates notice and special water meter reading.
  • Making adjustments to the rates.
  • Liaise with the other conveyancers regarding settlement.
  • Ensuring all special conditions in the contract have been satisfied or fulfilled.
  • Liaise with financial advisers or institutions regarding funds for settlement.
  • Witnessing legal documentation.
  • Preparing settlement statements, and
  • attending settlements on behalf of their client.

Currently I am already working in this position for another law firm within the South Burnett. However it is good to know that I may be liasing with another conveyancer.

Week 1 – Organisational and Objective goals

Lets firstly start by looking quickly at the firm of my choice Woods Murdoch Solicitors.

Based in the small town of Kingaroy, Woods Murdoch is the smallest law firm with only one Lawyer and 4 staff members. Qualified and experienced legal professionals this firm offers legal services at cost effective rates along with being an agent for Legal Aid. Woods Murdoch is the only firm in the South Burnett that handles Legal Aid family matters along with criminal matters aswel.

Woods Murdoch Solicitors is located only 5 minutes from the local Police Station, Magistrates and District court.

With the firms commitment to the client it has made their reputation as one of most experienced firms within the South Burnett.

Personally I have been involved with this firm as their conveyancer for just under 2 years. I have often had to find solutions while still managing to keep my clients happy. Prior to this have done study in business and have an understanding of the foundations of running a business and how to apply these concepts within the workforce. I feel I am confident in the area of law I am in however I wish to extend my knowledge in the other areas so I may better myself and advance my learning.
